VACATION RENTAL AGREEMENT

PROPERTY & AMENITIES: The property is in the county of Beaufort, State of South Carolina. The Property is fully furnished and equipped for light housekeeping. The following amenities are included with the Property:
Self Check-in – any time after 4 PM on Arrival Date, Guests can conveniently gain access via the smart-lock
Wireless Internet & Streaming Capability – Guest can access their personal streaming services
Bed linens/Bath towels/Recreational towels – provided for maximum occupancy
Starter Supplies – Guests are responsible for purchasing additional supplies and all food and beverages.
Fire Pit – if applicable
Propane Grill – if applicable
Pool – if applicable
24-hour on-call service
Security Cameras, if applicable – security cameras are located on the front/back exterior of the property and record audio/video surveillance 24/7
RENTAL PARTY: All persons in the rental party will be bound by the terms of this Agreement. A minimum age of 25 years is required for all Guests, unless accompanied by a legal guardian. Third-party bookings are strictly prohibited. Government ID must be provided. Maximum occupancy is 8 persons.
RENTAL PERIOD & CHECK-IN: The term of this agreement will be from 4 PM on Arrival Date until 10 AM on Departure Date, unless otherwise agreed to in writing. 4 PM check-in is not guaranteed. There may be incidences that are beyond Bluffton Traveler’s control. Unauthorized late check-outs are billed at $250.00/hour, assessed against the Guest.
ACCESS CODES: Bluffton Traveler will provide Guests with a temporary access code to the front door of the Property by check-in time on the Arrival Date. The code will be valid until check-out time on Departure Date.
RENTAL RULES & RESTRICTIONS: Guest agrees to abide by the rules and restrictions of the community, if applicable, a copy of which will be located in the House Manual inside the Property. Any community fines received during a Guest’s stay will be assessed against the Guest.
NO SMOKING OR VAPING of any kind is permitted inside the Property and all related trash must be properly disposed of on the exterior of the Property. Violation of the no-smoking policy will result in a $500.00 fee assessed against Guest.
NO LOUD OR UNRULY PARTIES OR GATHERINGS are permitted. QUIET HOURS begin at 10PM. Please be respectful of neighbors and their right to peacefully enjoy their home. Excessive disruption may result in immediate cancellation of the reservation, without refund.
NO PARKING in restricted areas, on lawns, or on other people’s property. Parking violations may result in HOA fines or may be subject to towing.
NO RECREATIONAL VEHICLES – RVs, boats, Uhauls, etc. are not permitted in communities governed by an HOA.
NO MOVING INDOOR FURNITURE. Damage to flooring/furniture and cost of extra staff if needed to return furniture to its original location will be assessed against Guest.
THERMOSTAT – DO NOT SET A/C BELOW 65 DEGREES. Abuse of the thermostat that results in the freezing of the unit will be billed against the Guest.
BATHROOMS – do not flush anything other than toilet paper. Flushable wipes are frequently the culprit of a backed-up toilet.
TAMPERING WITH ROUTER/MODEM/SECURITY CAMERAS WILL RESULT IN IMMEDIATE CANCELLATION OF RESERVATION WITHOUT REFUND.
CLEANING RESPONSIBILITIES – please dispose of all trash. If the property has a dishwasher, please start a load of dishes. Outdoor BBQ grill grates and exterior must be cleaned by the Guest if used during the reservation. If excessive cleaning is required upon check-out, a minimum charge of $250.00 will be assessed against Guest.
TRASH REMOVAL. In the event community trash pick-up day occurs during the reservation, pull trash receptacle to the curb the night before and return receptacle promptly after pick-up. A Bluffton Traveler representative will come by at the end of the workday the day before to confirm it has been pulled to the curb. Rental agent is permitted to enter the yard to pull trash receptacle to/from the curb in the event the task has not been completed by the Guest.
RESERVATION DEPOSIT & PAYMENT: A deposit of 50% of the Total Amount Due is required to confirm the reservation. This 50% deposit must be paid by credit card.and will be applied toward the rental rate. MasterCard, Visa, American Express, and Discover are accepted. Payment in full is due no later than 45 days prior to arrival. If payments have not been made the card on file will automatically be billed for the final payment. INSURANCE:
Damage Liability Waiver. This mandatory waiver provides up to $1000.00 for accidental damage to real estate or personal property. Intentional damage is not covered.
Trip Insurance. Bluffton Traveler offers RedSky trip insurance and highly recommends purchasing a trip insurance policy to protect payments already made in the event Guest needs to cancel a reservation outside the window for refund outlined in the cancellation policy. The trip insurance agreement is between Guest and the policy provider. Bluffton Traveler is not the policy provider of trip insurance.
SECURITY DEPOSIT: Reservations made through some third-party platforms may require a security deposit.
CANCELLATION POLICY: Bookings canceled at least 45 days prior to arrival will be refunded in full minus the reservation fee plus tax and travel insurance, if applicable. Bookings canceled inside of 45 days prior to arrival will not be refunded. There is no refund for early departures or no-shows. Purchasing Trip Insurance is highly recommended.
Cancellations due to Orders, Ordinances, Laws, Rules or Regulations Restricting or Prohibiting rental:. Reservations are subject to cancellation on the basis of any order ordinance, law, rule or regulation restricting or prohibiting short-term rentals which is or has been issued by any governmental entity, including orders of the Governor of the State of South Carolina and/or ordinances adopted by the Town of Bluffton. There are no refunds in the event of such order, ordinance, law, rule, or regulation.
Storms: There are no refunds in the event of a tropical storm, hurricane or name or numbered storm, all payments are forfeited and nonrefundable. If you have purchased Trip Insurance, any or all reimbursement is between you and the insurance company and will be subject to the policy terms and conditions. The insurance agreement is between Guest and Policy provider. Bluffton Traveler is not the policy provider.
CLEANING: Daily housekeeping services are not included in the rental rate. During the reservation, Guest will be responsible for keeping the Property clean and in good condition. Any unsafe or dangerous condition must be reported to Bluffton Traveler immediately. Cleanliness issues are required to be reported to Bluffton Traveler within twenty-four (24) hours of Arrival Date for the opportunity to remedy. The Property should be left in the same condition as it was found by Guest on the Arrival Date.
PETS: Pets are not permitted unless the property is designated as pet-friendly and the non-refundable pet fee has been paid. A fine will be assessed against the Guest for any animal or visiting animal discovered on the Property and is just cause for immediate cancellation of reservation without refund.
If a pet reservation has been made, Guest agrees to pick up after the pet and never leave the pet unattended. Pets are not allowed on furniture or in beds. If additional costs are incurred, Guests will be responsible.
Service Animals. Bluffton Traveler will make reasonable accommodations in accordance with applicable law and no pet fee will be charged. Bluffton Traveler reserves the right to withdraw consent and demand removal for any previously permitted animal in the case of damage to property or injury, threatening or aggressive behavior, and noncompliance by the guest in accordance with local ordinances and state law regarding custody and control of the animal.
Under no circumstances will a nuisance animal be tolerated and Bluffton Traveler reserves the right to withdraw consent and demand removal of any animal on the property in the event it is reported or complaints are registered that the animal is out of control, off-leash, aggressive, barking excessively or allowing animal on any other property.
HOLD HARMLESS: Should the owner elect to remove this property from Bluffton Traveler’s management or should the property be undergoing any major repairs or become uninhabitable for any reason, Guest shall hold Bluffton Traveler harmless from all related damages, loss, injury, cost or expense. Bluffton Traveler will provide comparable accommodations or refund in full.
DEPOSIT ACCOUNTS: Guest acknowledges that all rental monies are held in an insured, non-interest bearing bank escrow account.
SEVERABILITY: The invalidity in whole or in part of any provision(s) in this Agreement shall not affect the validity of the remaining portions or the application of such provisions in different circumstances.
CHOICE OF LAW: This Agreement shall be construed in accordance with the laws of South Carolina. In the event any litigation is initiated to enforce any provision of this Agreement, the substantially prevailing party as determined by the court shall be entitled to recover reasonable attorney’s fees and costs incurred in the litigation.
